  • Disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real time exchanges or to utilize the service on an AS IS basis as provided by us.
  • Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service.
  • “Stalk” or otherwise harass another.
  • Commit any fraudulent or unlawful act, whether in relation to any third-party provider of products and services on the Service or otherwise

SERVICE TERMS.

Joyful Care is a platform for connecting persons who are looking to engage self-employed professional carers to provide in-home live-in care (each a “Placement”), and self-employed care professionals that are part of Joyful Care’s network of Carers (each an “Joyful Care Carer”) that may be available to perform such Placement. The Company checks the backgrounds of each Joyful Care Carer via third party background check services; however, the Company does not guarantee or warrant, and makes no representations regarding, the reliability, quality, or suitability of such care professional providers. It is solely the responsibility of each Joyful Care Carer, and not the Company, to determine whether they are qualified and capable of completing a particular Placement. Even when accurate, reference checks do not necessarily predict future behaviour of a Joyful Care Carer. When you book a Placement or deal with a Joyful Care Carer, you should ensure that you use common sense and caution to ensure protection of you and others’ personal property and safety, including by supervising Joyful Care Carer as you would supervise anyone who provided a service to you that you did not know. The Company will not be liable, to the extent permitted by law, for any claim, injury or damage arising in connection with your use of the Joyful Care Platform and the Company is not responsible for the conduct, whether online or offline, of any user of the Joyful Care Platform.

  • We are an Introductory agency we only introduce and match self-employed carers to people who are looking for care at home (client) and we have no ‘ongoing role’ in the direction or control of the personal care provided.
  • We’ll source a selection of live-in carers which we feel most accurately suit client requirements. We will then send a care seeker profile of each carer and they decide who they want to hire.
  • After the carer has completed a placement with the client, we the agency will then transfer payment to the carer within 2 to 5 working days to their bank account they gave us when they register with us this depends on client payment methods. We are here to give support when the client or carer needs us e.g., to replace a carer and introduce and match another carer to the client if need be.
  • We have no ongoing involvement in how the care workers provide personal care to the people they have been introduced to.

Joyful Care Limited will ensure high quality of Service but will not be responsible for any Service error including criminal activity by Caregivers. You understand and agree that the Service offered by Joyful Care Limited directly or through Caregivers/affiliates of Joyful Care Limited has a risk of failure and/or adverse effects resulting in possible mortality or permanent disability. You understand and agree that Joyful Care Limited does not guarantee any recovery or outcome from the Service offered. You agree to provide a safe environment for Caregivers to discharge their duty and you will ensure that they are not harassed, abused, or troubled in any way physically or emotionally. You authorize Joyful Care Limited to collect patients’ data and use/share the same with others (without revealing the Patient’s identity). Joyful Care Limited will not be responsible for misuse of patient data by Caregivers, affiliates, employees, or another parties. You will make payments to Joyful Care Limited as per the terms agreed and will not link it with the outcome of the Service.

REGISTRATION AND ACCOUNT SECURITY

Our website users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:

  • You will not provide any false personal information on our website or create an account for anyone other than yourself without permission.
  • You will not create more than one personal account.
  • If we disable your account, you will not create another one without our permission.
  • Our Services are available only to individuals who are eighteen (18) years of age or older and can form legally binding contracts under applicable law. If you are not eighteen (18) years of age or older do not register to use the Site or Services.
  • You will not use our website if you are a convicted sex offender.
  • You will keep your contact information accurate and up to date.
  • You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.

LIVE-IN CARERS HAVE VARIOUS RIGHTS PURSUANT TO THE LAW WHICH INCLUDES (WITHOUT LIMITATION)

A minimal break of two hours per day during the daytime. On the request of the Joyful Care Carer, it’s permissible for these breaks to be banked to supply an extended particular person break, however, the minimal duration is 14 hours over 7 days: and Sanitary dwelling circumstances which embrace (i) a separate bedroom and appropriate bathing and bathroom amenities; (ii) neat and clean bedding and (iii) provision of ample meals. In respect of (iii), we suggest a minimal sum of £30 per week for the price of the Joyful Care Carer’s meals.

FEES

When a consumer makes a booking, Joyful Care Limited will assist and facilitate the transaction by offering a mechanism for paying amounts due in reference to every Placement (“Charges”). Charges for Placements are non-refundable (until at least 48 hours of the discovery of cancellation has been noticed) and can be charged to you in accordance with the Joyful Care Limited pricing schedule at the time of Placement is requested, which the Company Joyful Care Limited could update time to time. You may additionally be told by Joyful Care of any modifications made to the amount or basis of any funds due by you from time to time. You might be accountable for all taxes (aside from taxes based on the Company’s earnings) associated with the Placement carried out by Joyful Care Carers.

PRICE AND PAYMENT

You must pay in the currency in which the Service price is quoted or is selected. If you do not hold an account in the relevant currency you may pay by debit or with credit card (or any other method that Joyful Care Limited may introduce from time to time) and your card company should exchange the amount charged for the currency of your country at their current rate.

  • Payment may be made by credit card. A debit card or any other such method as Joyful Care Limited may introduce at its absolute discretion.
  • Joyful Care Limited reserves the absolute right to accept or refuse any payment made in any form.
  • To maximize security Joyful Care Limited does not hold any credit/debit card details. They are held by third-party payment providers.
  • Your credit card company may also do security checks to confirm it is you making the Order. Your statutory rights are unaffected by these Terms.

SMS MESSAGING

While you join the Service, Joyful Care Limited could send you SMS Messages to verify your phone number or acknowledge your Placement a Joyful Care Carer could be performing for you. A few of these messages could also be needed for the fulfilment of the Service and can’t be opt-ed out of. Relying on your present phone carrier service plan, you could incur Charges for these SMS Messages, and comply with not holding Joyful Care Limited liable for any Charges incurred.

FEEDBACK

Joyful Care Limited always welcomed your suggestions and feedback to enhance the service/features. Joyful Care Limited at this moment grants the User a non-exclusive, non-transferable, perpetual, irrevocable, royalty-free, and license to make use of, reproduce, disclose, sublicense, distribute, modify, and in any other case exploit such Suggestions without restriction under the conditions of these Terms & Conditions and for the duration of the Agreement.

INSURANCE

Joyful Care Limited has a £1,000,000 liability policy to cover every Joyful Care Carer to cover any accidental damage to your property. Policy coverage includes (with no excess, nor hidden fees): in relation to any claim for accidental damage to property and this will be for your account, not the Company.

CANCELLATION POLICY

In terms of service cancellation, a minimum of 14 days of cancellation notice is required before leaving the service. Regarding the cancellation, you can email at info@joyfulcares.co.uk or by phone at +441329 761995 .

SUBSCRIPTIONS

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”).

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Joyful Care Limited cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Joyful Care Limited customer support team.

A valid payment method, including credit card or PayPal, is required to process the payment for your Subscription. You shall provide Joyful Care Limited with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Joyful Care Limited to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Joyful Care Limited will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

FEE CHANGES

Joyful Care Limited, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Joyful Care Limited will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

REFUNDS & CANCELLATION

Cancellations & refund requests for Subscriptions may be considered by Joyful Care Limited on a case-by-case basis and granted in sole discretion of Joyful Care Limited.

PERSONAL INFORMATION

Your submission of personal information through the store is regulated by our Privacy Policy. You are to view our Privacy Policy.

IFRAMES

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our website.

INDEMNIFICATION

You agree to indemnify, protect and hold harmless to Joyful Care Limited, subsidiaries, affiliates, partners, officers, directors, agents, contractors, license, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your breach of these Terms and conditions or the documents they incorporate by reference or your infringement of any law or the rights of a third-party.

JURISDICTION

If there is any dispute arising out of the Site and/or the Services, by using the Site or the Services, you expressly agree that any such dispute shall be governed by the laws without regard to its conflict of law provisions, and you expressly agree and consent to the exclusive jurisdiction, for the resolution of any such dispute.

SEVERABILITY

In the event that any provision of these Terms and conditions is discovered to be unlawful, null, or unenforceable, such provision shall notwithstanding be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be viewed to be cut off from these Terms of Use, such determination shall not affect the credibility and enforceability of any other remaining provisions.

ENTIRE AGREEMENT

Our inability to exercise or enforce any right or provision of these Terms of Service shall not constitute a discharge of such right or provision.

These Terms of Use and any policies or operating rules posted by us on this website or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, pre-empt any prior or synchronous agreements, communications, and proposals, whether oral or written, between you and us.

Any ambiguities in the interpretation of these Terms of Use shall not be construed against the drafting party.
