At Joyful Care, we pride ourselves on facilitating a streamlined process that empowers clients to:

  • Explore an extensive online database to discover qualified self-employed Carers capable of delivering the specific services they require.
  • Rest assured knowing that all Carers undergo a rigorous vetting process, possess appropriate insurance coverage, and have obtained recent Disclosure and Barring Service (DBS) clearance.

As a distinguished ‘introductory agency,’ as per the guidelines set forth by the Care Quality Commission (CQC), Joyful Care serves as the conduit between clients and Carers through our online platform. It is important to note that we operate strictly as an introductory agency and not as an employment agency. We do not possess the authority to alter clients’ care plans, coordinate schedules, or influence the provision of care delivery.

Limitations of Liability: Usage of Joyful Care services by Carers is at their own risk. Our website, https://joyfulcares.co.uk, is offered free of charge, and while we strive for optimal functionality, we provide no guarantee against potential downtime or service removal. Joyful Care disclaims liability for losses or damages resulting from temporary service unavailability or technical errors.

Users are responsible for arranging access to our site and ensuring that all individuals accessing it through their internet connection are aware of and comply with the terms of use. Our site is intended for residents of the United Kingdom, and we do not claim that content is appropriate or available in other locations. We may restrict site access or availability of services/products to any person or geographic area at any time. If you access our site from outside the United Kingdom, you do so at your own risk.

Joyful Care holds no liability for injuries, controversies, losses, accidents, claims, or damages arising from the use of our services, including the online platform, and the provision of services by individual Carers. Carers acknowledge that entering into a contract with a client is their sole responsibility, with Joyful Care providing no warranty regarding client suitability, history, or character.

Participants in our Introduction service waive any rights to claim damages from those involved in creating, producing, or distributing Joyful Care services or related information. To the extent permitted by law, Joyful Care will not be liable for any loss, damages, misrepresentation, injury, accident, claim, cost, charge, expense, action, demand, or consequential losses arising from the use of our website and/or Carers’ services.

Our site, https://joyfulcares.co.uk, is intended for domestic and private use only. Carers must refrain from using the site for commercial or business purposes, except for identifying an appropriate client. Carers are

directly responsible for the content they upload, ensuring it is not defamatory, offensive, inaccurate, false, or misleading. Joyful Care reserves the right to remove content that does not meet these standards and may amend content for accuracy, correct grammar, and general presentation to enhance the user experience.

Joyful Care disclaims liability for any loss or damage caused by viruses, distributed denial-of-service attacks, or other technologically harmful materials resulting from site use or content downloads. We assume no responsibility for the content of linked websites, and links should not be construed as our endorsement. We are not liable for any loss or damage arising from the use of linked websites.

Vetting Processes: Upon registering as a Carer on the Joyful Care platform, you agree to undergo comprehensive vetting processes, which include visual verification of:

  • Passports or other appropriate photographic ID to confirm identity and the right to live and work in the
  • Stated qualifications and training certificates where
  • Existing DBS

In instances where Carers cannot provide a valid DBS certificate from the past 6 months, Joyful Care will conduct DBS checks at the Carer’s expense. Additionally, a minimum of 2 meetings with individuals/businesses seeking registration as a Carer on the Joyful Care platform is mandatory.

Permitted Use: The Joyful Care website is exclusively for private, non-commercial purposes, including:

  • Viewing and browsing the website.
  • Responding to genuine client enquiries about service
  • Making/reviewing/changing
  • Checking for client
  • Changing billing information and generating relevant
  • Communicating with Joyful Care representatives (Carers may also generate their own invoices).

Carers using our introductory agency are expected to deliver an exemplary level of service and adhere to the following principles when working with clients:

  • Treat all clients with respect, dignity, and compassion, prioritizing their needs
  • Act with honesty and integrity.
  • Act in the best interests of the client, maintaining their privacy, rights, and well-being.
  • Be reliable, dependable, and trustworthy.
  • Present oneself professionally and maintain confidentially.
  • Establish and maintain clear professional boundaries.
  • Be accountable for actions, seek guidance when needed, and report errors or omissions.
  • Avoid taking advantage of clients or accepting compromising gifts.
  • Promote client independence, diversity, and equality.
  • Obtain valid consent before providing care.
  • Communicate openly and effectively, documenting communication.
  • Never abuse, neglect, harm, or exploit those under their care.

Carers should be 18 years or older, legally able to form binding contracts under UK law, and have appropriate insurance for working in a client’s home. Joyful Care or the Client has no right to exercise control over the Carer’s methods, allowing the Carer autonomy within the necessary care delivery Acts while cooperating with reasonable requests.

Care Delivery: In your role as a Carer, you commit to delivering a professional, punctual, safe, compassionate, well-communicated, and diligent service to the client. You acknowledge the responsibility of recognizing your own competencies and refrain from accepting contracts involving duties beyond your level of competence. Acting honestly and with absolute integrity is paramount.

The Carer shall deliver services using suitably qualified personnel of their choosing and retains the right to substitute personnel, ensuring the Client’s reasonable satisfaction with the substitute’s skills and qualifications. The Carer remains liable for services completed by substitute personnel and bears associated costs. As a self-employed Carer, you have the right to find a suitable substitute for your absences, involving the client in identifying any required substitutes and keeping the client’s needs at the forefront of decision- making.

Carers must ensure compliance with:

  • Care Standards Act 2006
  • Care Act 2015
  • Safeguarding Vulnerable Groups Act 2006
  • Protection of Vulnerable Groups (Scotland) Act 2007
  • All other legislation and Governmental Authority guidance applicable to the care of vulnerable adults in the UK.

Additionally, Carers represent and warrant that they and their household members have not been subject to complaints, restraining orders, legal actions, or convictions related to criminal offenses, violence, abuse, neglect, theft, fraud, endangering safety, dishonesty, negligence, drugs, or inclusion in the sex offenders register or similar lists.

By registering with Joyful Care, Carers are expected to accept and adhere to all terms and conditions outlined in this document. Carers must recognize Joyful Care’s role as an introductory agency and refrain from creating agreements outside this service with introduced clients to evade Joyful Care fees. Introducing non-registered Carers to clients without Joyful Care’s written agreement is prohibited.

Once a contract is established between a Carer and a client, the Carer is bound by the terms of that contract. Any deviations from contract terms must be mutually agreed upon by both parties, as these agreements are legally binding. Joyful Care is not a party to these agreements and cannot mediate disputes unless the dispute resolution process is activated. Legal action may be pursued by Joyful Care, and funds held on account may be withheld to compensate for potential future business loss caused by unauthorized arrangements with clients.

Dispute Resolution Process

 Overview: Joyful Care facilitates a dispute resolution process to address disagreements between clients and self-employed Carers. Either party can initiate a dispute, and Joyful Care should be informed within 24 hours of the relevant event. Upon notification, Joyful Care examines contracts, compliance with terms, user data analytics, including but not limited to visit logging, messaging, geoverification, user feedback, and previous Carer behavior. Joyful Care reserves the right, at its discretion, to defer payment, reimburse, or cease contractual payments.

Release of Liability for User Conduct and Disputes: Agreements between clients and Carers are legally binding, and Joyful Care is not a party to these agreements. Joyful Care cannot mediate unless the dispute resolution process is activated. Dispute resolution should be attempted directly between the client and Carer. Joyful Care accepts no liability for claims, demands, or damages arising from disputes but offers a dispute resolution process for resolution.

Disputed Funds: Unpaid monies for a contract are held in an escrow account. Joyful Care does not guarantee reimbursement or full payment if the dispute resolution policy is activated. Equitable outcomes are sought based on available evidence.

Payments, Cancellations, and Refunds:

 Payments: Contracts are made directly between clients and Carers. If a client is unavailable to agree to fund release, Joyful Care may release funds to the Carer after reasonable efforts to contact the client.

Hourly and Daily Carer Rates: The Carer and client set hourly or daily rates, which should not change during a contract. Any rate changes must result in contract termination and the agreement of a new contract.

Joyful Care Fees: Joyful Care charges a 20% introductory commission fee on the Carer’s hourly rate. This commission is included in the rate on the Carer’s profile. Joyful Care reserves the right to alter commission terms.

Cancellations: Contracts can be terminated by the client or Carer. A 14-day notice period is ideal for regular hires, with exceptions for short-term contracts. Cancellations without sufficient notice may inconvenience clients.

Governing Policies

 Safeguarding Policy: Joyful Care abides by the Safeguarding Policy, complying with relevant legislation to ensure the well-being of clients and Carers.

Complaints Policy: Complaints are taken seriously, and a policy is in place to manage and address them promptly. Clients and Carers can refer complaints to hr@joyfulcares.co.uk.

Data Protection and Confidentiality Policy: By using Joyful Care, users consent to the processing of personal data in accordance with the Privacy Policy. Consent is sought before processing data unrelated to care.

Background Checks: Joyful Care conducts background checks and intermittent audits using third-party resources to ensure user safety. Users authorize these checks and release Joyful Care from liability associated with the results.

Breach of Terms and Conditions: Users are expected to recognize and abide by the terms and conditions outlined. Users agree to indemnify and hold Joyful Care harmless from any claims resulting from a breach of these terms.
